Licence Agreement and Disclaimer
0. This Licence Agreement applies to the "ImageLib" External
Component and any other software distributed with it which contains
a notice placed by iB2B Systems trading as "Artificia"
(also called "the copyright holder") or other authorised
party saying it may be distributed under the terms of this Licence
Agreement. Each licensee is addressed as "you".
A "library" means a collection of software functions and/or
data prepared so as to be conveniently linked with application programs
(which use some of those functions and data) to form applications.
The "External Component", below, refers to the "ImageLib"
external software library developed by iB2B Systems trading as "Artificia".
A "work based on the External Component " means
either the External Component or any derivative work under copyright
law: that is to say, a work containing the External Component or
a portion of it, either verbatim or with modifications and/or translated
straight forwardly into another language. (Hereinafter, translation
is included without limitation in the term "modification".)
"Source code" for a work means the preferred form of the
work for making modifications to it. For a External Component, complete
source code means all the source code for all modules it contains,
plus any associated interface definition files, plus the scripts
used to control compilation and installation of the External Component.
1. You may not copy or distribute copies of the External Component
as you receive it, in any medium.
2. You may not modify or reverse engineer your copy or copies of
the External Component or any portion of it, thus forming a work
based on the External Component, nor copy or distribute such modifications
under the terms of Section 1 above.
3. An Omnis application library that is designed to work with the
External Component, is called a "work that uses the External
Component ". Such a work, is a derivative of the External Component
because it depends upon availability of portions of the External
Component. Section 4 states terms for creation and distribution
of such applications.
4. You may develop "work that uses the External Component"
provided that such work is for evaluation purposes only. You
may not distribute such work without the express written permission
of Artificia. Licensing of the External Component is entirely
separate and additional to the licensing of any other intellectual
property that forms an element of the application. For example,
Omnis runtime licensing must be separately sought through Raining
Data or their appointed agents.
5. You may not copy, modify, sub-licence, link with, or distribute
the External Component except as expressly provided under this Licence.
Any attempt otherwise to copy, modify, sub-licence, link with, or
distribute the External Component is prohibited, and will automatically
terminate your rights under this Licence.
6. You are not required to accept this Licence, since you have not
signed it. However, nothing else grants you permission to
employ the External Component or its derivative works. Use
of the External Component is prohibited by law if you do not accept
this Licence. Therefore, by employing the External Component
(or any work based on the External Component), you indicate your
acceptance of this Licence to do so, and all its terms and conditions
for copying, distributing or modifying the External Component or
works based on it.
7. A court judgement, allegation of patent infringement, or any
other circumstance that leads to conditions being imposed upon you
either by court order, agreement or otherwise define a set of "subsequent
conditions". If any subsequent conditions are imposed
which contradict the conditions of this Licence, then the Licence
will be superseded in part by such conditions. Any portion
of this Licence which does not contradict a set of subsequent conditions
will be held to be valid.
If any portion of this section is held invalid or unenforceable
under any particular circumstance, the balance of the section is
intended to apply, and the section as a whole is intended to apply
in other circumstances.
8. The terms of this Licence agreement are to be adjudicated within
the laws of the United Kingdom.
9. THERE IS NO WARRANTY FOR THE LIBRARY, TO THE EXTENT PERMITTED
BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE STATED IN WRITING THE COPYRIGHT
HOLDERS AND/OR OTHER PARTIES PROVIDE THE EXTERNAL COMPONENT "AS
IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED,
INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE
QUALITY AND PERFORMANCE OF THE EXTERNAL COMPONENT IS WITH YOU. SHOULD
THE EXTERNAL COMPONENT PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL
NECESSARY SERVICING, REPAIR OR CORRECTION.
10. IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MAY MODIFY AND/OR REDISTRIBUTE THE EXTERNAL COMPONENT AS PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE EXTERNAL COMPONENT (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF THE EXTERNAL COMPONENT TO OPERATE WITH ANY OTHER SOFTWARE), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
